
What does "released on summons" mean?
If I am arrested by police and taken into custody for a criminal offense in Virginia, do I have to stay in jail until my trial or can I get released before trial?
Since the shooting occurred in the parking lot of an apartment complex at a time people would be getting up for work, I thought some people may have seen what happened and called 911, so I asked the police and prosecuting attorney to give me the 911 records. For whatever reason, they refused, but eventually, I was able to get the Court to order they provide the information to me. With the help of a private investigator, we kept knocking on doors and we found some people who saw and heard various things. We kept plugging away with our investigation and we learned not only that the "witness" who identified the client was his ex-girlfriend - someone who might be mad at him - but also that she was rumored to be dating a drug dealer who carried a gun. We knew we were getting close and eventually we found a witness who said it was a drug deal that had gone bad and the ex-girlfriend identified the client to divert attention away from her current boyfriend. Unfortunately, the witness was scared, had left the state and wasn't interested in testifying in court. It had been awhile since the ex-girlfriend had seen the client and when she described his facial hair she guessed wrong. Fortuantely we found a photograph taken by his employer around the date of the incident which showed her mistake.
Our investigation of this incident was exhaustive, and eventually we were able to raise enough doubt about the ex-girlfriend's story, that the prosecuting attorney chose to dismiss the charges against the client without even having a trial.
