Virginia DUI / DWI Blood Test Result 0.29 - Not Guilty - Part 2 of 2

Kevin Wilson, Esq. of The Wilson Law Firm to handle this very serious case.  When Mr. Wilson arrived at the courthouse on the day of the trial, the prosecuting attorney was visibly disturbed by the facts of the case and refused even to discuss the possibility of a plea bargain to resolve the case by agreement,  The client had two options:  (1) plead not guilty, have a trial, force the government to prove the case beyond a reasonable doubt and preserve at least a chance at victory, or (2) plead guilty, forego the right to have a trial, give up any chance of victory and focus on trying to persuade the Court to limit the punishment to the mandatory minimum sentences set out in Virginia law.  

The client chose to fight, so Mr. Wilson entered a not guilty plea on behalf of his client and the case proceeded to trial.  Mr. Wilson's cross-examination of the police officer revealed mistakes and inconsistencies with the arrest process and corresponiding documents, and ultimately Kevin was successful in getting the result of the blood alcohol test suppressed.  Since Mr. Wilson was able to keep the blood alcohol test from being used during the trial, the prosecuting attorney had to rely on the client's performance on the roadside sobreity exercises to prove he was impaired.  However, Mr. Wilson used his extensive education and training regarding the proper administration of Standardized Field Sobriety Tests to successfully challenge the roadside sobriety exercises performed by his client, at at the conclusion of the trial, affter considering all of the evidence and arguments presented, the Court rendered a two word verdict: NOT GUILTY.
