Virginia DUI / DWI, Reckless Driving and Refusal Charges Dismissed - Part 2 of 2

Manassas. Virginia DUI Defense Attorney T. Kevin Wilson and the client arrived at court the following day, prepared for trial, and the prosecutor asked whether the client would be accepting the plea bargain.  Skeptical about how the prosecutor would proceed, Mr. Wilson advised the client to be patient, informed the prosecuting attorney the client had not yet decided, and waited.  Mr. Wilson was shocked as he watched lawyer after lawyer plead their clients guilty in cases involving the same officer.  However, he remained patient, and thinking the prosecutor wouldn't actually put the officer on the witness stand, he advised his client to decline the prosecutor's offer and have a trial.  Mr. Wilson's hunch was correct, and when he informed the prosecuting attorney that his client respectfully declined the plea offer, the prosecutor dismissed all three charges against the client.

100% of clients who plead guilty will be found guilty.  You can't win if you aren't willing to go to trial and fight.  Several lawyers, with cases brought by that same officer, advised their clients to plead guilty that day.  However, Mr. Wilson's skill, instincts and experience led him to advise his client to go to trial - advice which saved the client from having a permanent criminal record; spending thousands of dollars on fines, costs, alcohol education and treatment, and insurance premiums; and having to complete a two year period of probation with the fear that the slightest misstep could result in incarceration.
