2nd Offense Virginia DUI / DWI Reduced to Intoxicated in Public
A client came to The Wilson Law Firm seeking representation after crashing into a pillar in a parking garage and being arrested for a Virginia DUI. This was not his first DUI arrest, but it had been about 7 years since his last DUI. He was embarrassed and ashamed that he had been arrested for another DUI, and he feared the mandatory jail sentence and 3 year license suspension which would be imposed if convicted of this DUI would cost him his career. We immediately began working on the legal issues, and we got the client into a 30 day inpatient treatment program to help him address personal issues which seemed to have been troubling him for quite some time. Virginia's Implied Consent law requires motorists using public roads to submit to a breath or blood test if arrested within 3 hours of driving, but in this case there the time of the accident could not be established so it did not apply. In addition, Field Sobriety Test evidence was both limited and questionable since the client had been knocked unconscious, was being treated by medical personnel when police arrived and was subsequently taken to the hospital by ambulance. The client successfully completed the treatment program and my specialized education, training and experience in the field of Virginia DUI defense enabled me to identify problems with the evidence and get this 2nd offense DUI reduced to being Intoxicated in Public with a $25 fine. We got the client some help and saved his job by avoiding the mandatory jail sentence and license suspension which would have been triggered by a DUI conviction.
