Beating Virginia DUI and Refusal Charges

A soldier with the United States Marine Corps called Manassas. Virginia DUI Defense Lawyer T. Kevin Wilson in need of assistance.  He had been arrested in Virginia and charged with both Driving While Under the Influence of Alcohol (commonly referred to as DUI or DWI in Virginia) and Unreasonably Refusing to Submit to a Breath Test (commonly referred to as Refusal in Virginia).  He was scheduled to deploy to Iraq in the near future and he was concerned about how these charges of DUI and Refusal in Virginia could impact his pending deployment, his military career overall and his life in general.  He feared not being able to continue to serve his country and he decided to hire T. Mr. Wilson's initial investigation uncovered information which, due to his extensive knowledge of search and seizure law, he recognized may provide a basis to challenge the legality of the initial stop of the client's vehicle by police.  Further investigation solidified Mr. Wilson's belief that the initial stop of the client's vehicle may have been improper and that issue became one of the focuses of the defense.  On the day of trial, when faced with Mr. Wilson's argument regarding the initial stop of the client's vehicle, the prosecuting attorney offered to dismiss the Refusal charge, to amend the DUI to Reckless Driving and to recommend the Court simply impose a small fine.
