Virginia DUI / DWI, Reckless Driving and Refusal Charges Dismissed - Part 1 of 2

A potential client called The Wilson Law Firm looking for help.  A few nights earlier he had gone out with some friends and, although he had kept his drinking to what he thought was a responsible level, he did have a few beers.  On the way home while making a u-turn his vehicle went a little wide and he ended up in a drainage ditch adjacent to the road.  Police were called to the scene, and after a typical Virginia DUI investigation he was arrested and charged with DUI, Reckless Driving and Refusing to Submit to a Breath or Blood Test.   When asked why he had contacted The Wilson Law Firm, since the case was pending in a jurisdiction some distance away, he said he wanted Mr. Wilson because he wanted "the best". 

The caller hired Manassas. Virginia DUI Defense Attorney T. Kevin Wilson to handle the case, and as Mr. Wilson investigated the case he discovered several damaging pieces of evidence including a Preliminary Breath Test result of 0.221 and alleged admissions to police by the client that he was drunk and knew he was guilty.  Although things did not look promising, as with most cases, there were discrepancies between the officer's version of events and the client's which would prove to be important if the case proceded to trial. 

On the day before trial Mr. Wilson received a surprising call from the prosecuting attorney during which the prosecutor said the arresting officer was the subject of an Internal Affairs investigation and made what would normally be an extremely reasonable offer regarding the dispositon of all three charges.  Specifically, the prosecutor offered to dismiss both the DUI and Refusal charges in return for the client's guilty plea to Reckless Driving.  In addition, the client would receive a suspended jail sentence and have to pay a fine, complete a 2 year period of probation and complete substance abuse education and treatment through VASAP.
