Virginia DUI / DWI & Refusal Charges Dismissed - Part 3 of 3

Unprepared to address the issues raised by Manassas, Virginia DUI Defense Lawyer, T. Kevin Wilson, and unprepared to deal with the testimony of the expert witness if the case proceeded to trial, the prosecuting attorney asked the Virginia General District Court Judge to grant a continuance.  Of course, since Mr. Wilson had driven some distance to be present and brought an expert up from Florida, he opposed rescheduling the trial.  After the attempt to reschedule the trial was unsuccessful, the prosecuting attorney dismissed both charges. 

However, in a move which was at best motivated by a lack of familiarity with the Virginia Breath Alcohol Testing protocol, and at worst motivated by vindictiveness, said she planned to seek indictments, have the client re-arrested and proceed to trial in the Virginia Circuit Court.  T. Kevin Wilson agreed to share all the information he had and he asked the prosecutor place a call to the Department of Forensic Science to discuss Virginia's breath testing protocol before seeking indictments and having the client re-arrested.  The client didn't hear anything for quite some time and we at The Wilson Law FirmI thought the case was over.  We were wrong.  True to her word, the prosecutor did seek and obtain indictments accusing the client of the very same Virginia DUI / DWI and Refusal offenses, and we started the entire process over in the Virginia Circuit Court. 

However, Manassas. Virginia DUI Defense Attorney T. Kevin Wilson is pleased to report that the outcome in the Circuit Court was the same as in the General District Court:  both charges were dismissed.
