Virginia DUI / DWI with .14 Blood Alcohol Level - NOT GUILTY

A potential client came to The Wilson Law Firm nervous and scared.  She had been arrested and accused of DUI in Virginia and gave a breath sample which registered 0.14, well above the legal limit in Virginia of 0.08.  Concerned about her career as a nurse, she chose to retain the services of T. Kevin Wilson of The Wilson Law Firm, in Manassas, Virginia.  On the night of her arrest, the client began her journey home as the passenger but at some point switched to being the driver.  An off duty officer fell in behind the vehicle at some point and followed the client to her house.  The officer who eventually arrested the client arrived a few minutes later and never saw the client driving or operating a vehicle.  As an experienced DUI Defense Lawyer, T. Kevin Wilson knew the legal significance of these unusual circumstances, and he successfully argued that the arresting officer violated Virginia's Warrantless Misdemeanor Arrest Rule, which resulted in the result of the breath test being thrown out.  The client had not performed any field sobriety tests and the Court agreed there was not enough evidence to find the client guilty so the case was dismissed.  T. Kevin Wilson's extensive education, training and experience in the field of Virginia DUI Defense enabled him to identify the significant issues in this case, which resulted in the client being found not guilty.
