Virginia DUI & Unreasonable Refusal Charges Defeated

A young Marine called for Manassas. Virginia DUI Defense Attorney T. Kevin Wilson of The Wilson Law Firm seeking assistance with Virginia DUI & Unreasonable Refusal charges.  A few nights earlier, he had dinner and drinks with his girlfriend, and after he dropped her off he was on his way to the barracks when he decided that he didn't feel comfortable driving.  He pulled off the road, parked on the shoulder, turned the car off and removed the keys from the ignition.  Some time later, he was awakened by a Virginia State Trooper and after a typical DUI investigation, which included a Preliminary Breath Test result of 0.16 (twice the legal limit) he was arrested for DUI.  After blowing and getting an Invalid Sample error message on the Intoxilyzer 5000 he was charged with Refusal.  

Although being off the roadway with the keys out of the ignition is NOT a defense to a Virginia DUI, under Virginia law it does change the way the officer needs to handle the investigation and the arrest.  Thanks to Mr. Wilson's extensive education, specialized training and many years of experience focusing on DUI Defense, he was aware of these subtle distinctions in Virginia's complicated DUI laws, and that knowledge enabled him to get the REFUSAL DISMISSED and the DUI AMENDED to a non-moving violation (no demerit points assessed by DMV) with a nominal fine.
