Virginia Drugged Driving Laws

Under Virginia law, it is unlawful for anyone to drive or operate a motor vehicle while under the influence of any narcotic drug or any other self-administered intoxicant or drug of whatsoever nature, or any combination of such drugs that impairs his or her ability to do so.

You can, therefore, be charged with a DUID if impaired by a street drug, prescription drug, or even an over-the-counter drug or a combination of these types of drugs found in a blood sample. A doctor’s valid written prescription is no defense if your driving was observably impaired. Many prescription drugs as well as over-the-counter drugs affect the nervous system, motor skills, and judgment.
